Changes to Temporary Skill Shortage Visa


There has been a change in the requirements for employers nominating potential employees for a Temporary Skill Shortage visa. This visa has 3 stages; sponsorship, nomination and applicant. The changes apply to the nomination stage of this visa.


Prospective employers have always been required to advertise their position in 2 places as a labour market testing measure but are now required to advertise their vacant position using the ‘JobActive’ site as well as 2 other sites. The JobActive site an Australian Government site, and is a place for job seekers as well as prospective employers. There is no cost in using this service to advertise or view positions.


The position must be advertised for a minimum period of 28 days. The 28 day period starts when the advertisement appears on the site, not from when it is paid for. This is applicable for nominations lodged on or after 1 October 2020.


Employers are encouraged to place their advertisements well ahead of the 28 day period to ensure their advertisement is placed on the JobActive site ahead of the current visa holder’s visa expiry date. You must also ensure that all the required information is stipulated at the time of submitting the advertisement. Incorrect or missing information can cause delays in your advertisement going live and not getting the advertising right, in the first place, may result in a refusal for the nomination.
